Sell & Buy HDB During Separation

Dear All,
Can someone advice if it is possible for me to sell my current HBD (co owned with my hubby) and buy my own flat (I am above 35 years old) during my separation?
My separation term is only due end Aug 2013. But since the divorce process is gonna takes 4-6 mths to finalise, I was thinking of selling our current HDB and buying my own place. I hope to start my new life in 2014 with a fresh beginning.

response typically fast for straightforward cases. for cases where u need to appeal and ask for waivers, and IF u want a favourable reply... talk to an officer face-to-face.

emailing is convenient, but it also sets the tone for the chances of u getting an appeal thru.
 
That's right. You wanna ask a question or get clarifications, fire an email or call up main customer service line. You want an exception to established policies, you have to raise it with an officer in person.
 
Hi... I just went through similar situation.. You'd need the final court order to be able to sell the flat... I think you are able to sell one you get the interim court order if you engage own lawyer to do it.. For details.. Still better to check with hdb... Hope this helps for now.. All the best!

My HDB flat is on the way, almost completed. Will be collecting the keys this year.
In the case of divorce, we should be giving up on the flat. But how can I buy a flat under the single/divorcee scheme?

TS is asking on separation which is not possible under HDB to buy another flat. Are you asking on divorce or separation since you are in a similar situation? If it is divorce, you would need to get the final judgement and above 35 before you can buy another resale flat under single scheme. If you got kids, you can apply even when you are below 35 provided the kids are under your custody.

For the flat that is underway, you would have to surrender to HDB and forfeiting your deposits.
