need advise to buy HDB flat

Hi all.. I just got married last month. Hubby and me wanna buy a 3 or 4 room HDB flat. But we have an issue, actually its my issue. Need advise ASAP.

my ex husband are not being cooperative to delete my name from our matrimonial flat. He wants to retain the flat. Previously, we took that 5-rm hdb flat together by bank loan. I'm the second owner but I have not contribute any of my CPF throughout. Now that we are divorced, I agreed upon him retaining the flat coz my kids which is actually a shared custody but he is the care and control so they will be staying with him and plus he can afford on the payments.

Now, I just got married and we are staying in a rented room. Can somebody pls advise on how can we buy a HDB flat. Do we need to get an agent? How much will it cost us for their service? We really can't afford much though:oops:..

(ps: my husband is the first-timer buyer while me 2nd time:))
 
My understanding is that you can't actually apply for a new HDB as long as your name still resides in your matrimonial flat. HDB will see it as you are trying to hold 2 HDB flats.

Best is to remove your name from the matrimonial flat prior to applying for a new BTO or resale.

If your ex-husband is not cooperative on the matter you can always bring it to HDB, to get their advice on how to remove your name from your matrimonial flat, bring along all necessary documents like proof of divorce and your new marriage certificate.
 
In the interim/final judgement of the court orders. Include a clause to mentioning that you will transfer your share of the property to him. (I assume since you are not make payments for the loan and didn't use CPF, you should not incur any /little lost).

Get him to contact the bank to restructure the home loan for him to be the sole owner. Once this is done. You will be eligible to purchase a resale HDB or ballot for BTO or EC.
