Anyone has any lawyer that is good to recommend? My husband has given me a writ of divorce. And I need to seek consultation on the documents. I am very tired. Sometimes i think the stress of divorce are with the 8 days of MOA and 22 days to file defence. Shouldnt the law be more accomodating to the defendant or is it the law is protecting the plaintiff?

Appreciate if anyone can provide good lawyer.

At times, I wish to defend the case but sometimes, am thinking why am I the one suffering and my husband just throw me at a corner.

You can ask for an extension of the deadline to provide a response. Simply speak to his lawyer on the phone and follow up with an email. You can ask for another 14 days on top of the eight days.

Hi
I have more or less guess the end result is the same, ie what he has wished for.
Am I stupid to spend money on engaging a lawyer just to gamble if the judge would dismiss the case?
Hence, not sure if it is realistic to spend a few grands just to defend the case.
He has been telling me to just agree as neither the law / me can change him.
But I just felt it is a pity as our conflicts started with inlaws and thereafter letting the problem sit and now he claims no more love. That is why now i am still trying my last bit to save the marriage.
But am i stupid? And also the money worth to spend for fighting a deadless case?

clearwater,

why waste money to defend a "dead" case. How can you fight if he is insistent? You can't hold on to a marriage that is gone.

sometimes i was wondering, why is it so expensive to divorce? .. does it mean only people who can afford lawyer fees can divorce? .. hmmm...

its because we need expertise of lawyers. Its not your neigbourhood contractor PCK that advise you and act for your legal matters. Just as why medical is expensive. And, you don't become rich before falling sick.

Clearwater, it only takes one party to end a relationship or marriage. Not even the court is prepared to enforce a marriage when either the wife or husband wants out. So, you nor the court can stop your husband from wanting out of the marriage. Divorce is only a matter of time in your case and in many other cases too.

I don't think divorce is that expensive as compared to a marriage - a marriage will need much much more: house, wedding, photography, banquet, honeymoon etc etc.. even simple wedding with just honeymoon will cost easily a few Ks..

Divorce, if uncontested and initiated by one party will cost around 2.5K to 3K. If both are agreeable and split the cost - it is 1.5K per person.

I have no kids. Married for 4 years.
Alimony, he did not indicate. Moreover, probably the income i am earning, is average but does not justify any amount.
A marriage is money that you spent happily and tangibles and intangibles results.
But a divorce is money that is not willing to spent by defendant as they are people caught in a situation but to spent money.
My 2 cents. Hence, these 2 events are not comparable.

If you don't want to contest the divorce, you don't have to pay a single cent.

Anyway, if one party is bent on ending the marriage - whether the other party happy or not - still need to divorce. So why not spend the money and get out of the marriage and at least can start a new life and there is possibility of happiness. Or rather you want to be stuck and be forever unhappy?

Since there are no children from the marriage, and if the proposed terms are reasonable, you don't have to engage a lawyer's service and will not incur a single cent.

If you do not want a divorce you should convince your husband instead of the judge.

"if i am consulting a lawyer, what are the key questions i should be raising during the discussion?"

Depends. Are you contesting the divorce itself or the proposed terms on division of joint properties and/or alimony.

I do not wish for divorce. I have tried my very best to convince him. But i think the end results is tstill the same. ie divorce.
And he has disappear, unable to contact him and he has shifted.
My heart is shattered. I will just be asking the lawyers, is there anything that is disadvantage to me.
Because i found the CPF contribution amount by me is understated by 50%. Just to clarify what are pointers are not factual.

The CPF statements and standard enquiry with HDB would have laid out the respective CPF contributions in amount and ratio nicely. It could be his proposed plan for the division of matrimonial assets in favour of himself. Do consult your lawyer.

You can't understate the CPF contributions. CPF will do the calculation and will ensure the proportionate amount credit into the account if the flat is sold.

You can't even return more than the fair-share in either account even with the agreement of both parties. Let alone to try to get more than your fair share

Precisely, SM, that's why I wouldn't think his lawyer could be that stupid to understate the CPF contributions. The CPF statements and standard enquiry with HDB would have stated the respective contributions. It may not be the amount going back to the respective CPF accounts but perhaps the proposed spilt of the profit from the sale of the flat. But guessing only. Still best to have a lawyer eyeball the divorce papers.

Anyway it is also useless to say how much each contributed via CPF because the amount will be calculated EXACTLY by CPF and refunded back in proportion by CPF. The only relevant contribution is CASH contribution.

He has selected the transfer of flat to him at $0 cash with 50% split.
But i know he would be fair to me, which he also did assure me and i believe in him.
I wish to talk to him to amend the grounds.
My friends have been telling me, to get some monetary value as he is very unfair to me throughout. But I do not want to turn this into an ugly event. And thus, do not want his money as well. I dont mind transferring to him at cost. But sometimes, his action of MIA just makes me angry. Is it me that is so horrible or he escape and throw his problems to me upon him engaging a lawyer. What is left behind is my family standing beside me and me facing the divoce alone. The divorce costs was also indicated in the claim. And I believe he will not want to split the costs but he will bear it himself. And true enough, he did verbalise the fact. But just wondering even if this is your lawyer acting in your best interest, you should have the final say if she is once the loved woman in your life and why appear calculative in papers when it is your lawyer's idea and not yours? Perhaps that is why a man and woman have different thinking.

I don't think any difference in man's or woman's thinking. A lawyer will always try to advise you and to secure for you the best. Sometimes we just listen to the lawyer. Not necessary will mean that he is calculative.

I suggest you talk nicely to him.

He does not want to be reached. I cant reach him at all. But will try to sms him. Thanks everyone for your help. I am sad but not alone.

seems you're making it hard for yourself in wanting to repair the marriage despite him being that determined to go through the process. since you feel he is offering a fuss free & fair deal to you, why don't you just wrap the entire thing and move along....

"Anyway it is also useless to say how much each contributed via CPF because the amount will be calculated EXACTLY by CPF and refunded back in proportion by CPF. The only relevant contribution is CASH contribution."

What cash contribution are you referring to? For what and to who?

What I was trying to explain is that some plaintiffs do propose that the profit spilts according to the ratio of their CPF contribution. It's not entirely irrelevant. For example, if the CPF contribution is 70-30, after the CPF accounts are refunded, whatever that is left, that is, the profit, can be spilt according to this same ratio.

"He has selected the transfer of flat to him at $0 cash with 50% split."

Does it mean the ownership of the flat is transferred to him up till a certain date when he will have to release it to the market and the profit be spilt 50-50?

He has selected option 5, ie my share in the flat will be transferred to him. And he has further selected with no cash consideration, he will refund me the cpf money used for the flat and accrued interest. outstanding loan will be 100% borned by him. Sorry, i have mis-read. The 50% is conveyancing, stamp registration and admin fee of the transfer borned himself and me at 50% each. The transfer tis with 3 months of the grant of the final judgement.

The real cost to you looks minimal since it's 50% of conveyancing fee, stamp fee and admin fee. But you might want to look at your opportunity cost for such a proposal. That is, after servicing your housing loan for four years, you get no reward for the risk undertaken.

I know this may sound avaricious but since the property market is on the up now especially with majority of HDB flats selling above valuation, it may make better financial sense to suggest that the flat be sold in the open market as opposed to transferring the flat to him.

Well,if there's a decision to be made on the transfer of the flat, both parties need to agree too.

The value of the flat should be more than their original purchase price and what her husband is suggesting would be just to pay back to her the cpf contribution she'd made to the flat over all these years. By selling in the open market, it makes more sense. I know clearwater indicates that she does not want to make things ugly and is open to the transfer at no cost..but asking to sell the flat which both of them co-owned isn't really unreasonable and if both can profit out of it, why not? Just a suggestion..not forcing it down her throat..

"to sell the flat, both parties (co-owners) must agree"

But HDB has a policy that if you are no longer husband and wife, you can't hold on to the flat jointly. It's either you sell or transfer it to eligible person/s.

""Anyway it is also useless to say how much each contributed via CPF because the amount will be calculated EXACTLY by CPF and refunded back in proportion by CPF. The only relevant contribution is CASH contribution."

What cash contribution are you referring to? For what and to who?"

Doll, I believe she meant that other than using CPF, they also paid cash for the loan.

Only the CPF contribution will be returned according to proportion, not cash contribution.

Clearwater, did u agree to transfer the flat to him at zero cost? Some more must pay 50% for the transfer charges... sounds like he's only thinking of himself.. unfair leh...
