I hope for anyone who know or had experienced with my situation right now to kindly advice me.

I am currently under going divorce. The court have finalized our divorce i got joint custody of my only child and care and control under me as well.

The thing that I am worried about is. before we got divorce we had a 4-room BTO ongoing estimated to be completed in late 2016. However, based on my situation now. I would like to know as it is joint custody would I be able to take over the flat with me and my child's name? Secondly had anyone experienced or chances of changing from a 4-room bto to 3-room bto?

The handling of the bto should be in the final judgement as well. Otherwise, you will have to ask HDB for advice.

For now, the flat is under you and your ex-spouse. By right if there is a divorce before the completion of the flat, the flat will have to be surrendered back to HDB at a loss. Although you are having joint custody, you will be able to apply for a flat with your child under a family nucleus as you are the care and control parent. I'm not sure if you can take over the flat under this family nucleus. You can try checking with HDB officer.

The chances of changing from a 4 room bto to a 3 room bto under the same project is pretty low. But it is possible for you and your children to re-apply for another 3 room flat from the sales launches after the divorce is finalised.

Alternatively, you can approach HELP Family Service Centre for assistance. Contact number : 64575188. It is an organization which specifically helps divorced families. Good luck.
