Varying court of order divorce case

Dear All,

My divorce have been finalised. We have a BTO which is completing end of this year. On the court of order is stated to be surrender back to HDB.

After some serious consideration, my ex spouse have agreed to let me take over the HDB flat with my Son. How can I vary/change this court of order and how Long can it take? Because HDB only give me till 31st May 2016 as deadline. If not it will be cancelled. I am very worried.

Anyway with similar case before pls kindly advice thank you

Thank you. Do I have to go back to my previous divorce lawyer or I may consult a new one? As my previous lawyer cost me a bomb for uncontested and I find it over priced. Anyone know roughly how much it is going to cost?

You can go to a new one if you find the previous lawyer too expensive. For varying of court order, it should be around 3.5k. Need to shop around.

My divorce was finalized in 2009, which my ex-husband had the care and control for our 2 kids. During this period, he had not been providing them with enough. In 2015, my kids had expressed their wish to stay with me and I had applied to take over the care and control with reasonable access granted to him. However, since after the kids moved over to my place, he had refuses to let my boy (my girl refused to go back to him) stay over with him during the weekend. Is there anything I can do? I am looking for a new lawyer to help me on this issue as my existing lawyer doesn't seem to have the interest anymore.

Thanks for replying.

I am looking for possible options to add variation to the court order, to make him fulfill his responsibility as a father. At least he should allow the children to stay with him over the weekend.

For variation of order, you can approach the Family Court to do the variation. But it will be good to at try speak to him about it first instead of going it through the legal way. I'm more concerned how will the children be thinking if father does not allow them to stay.

Had tried talking to him, but it is much easier to talk to a cow.

I had no choice but to go thru the legal way, but I have to have professional advice. I was told that there is nothing I can do as he is not breaking any law even though he does not want to let the children stay over.

The only way is to give him care and control. Then you have the option of letting the kids stay over with you while he will have the full obligation to look after them. Otherwise, with child access, he can choose whether to see his children during his time. Which puts the full responsibility of the children with you. Any loving father won't forgo time with his children unless there is no choice. If he doesn't care, just leave it be. Kids are better off with parents who actually take care of them.
