My parents are 60 years old and going through a rough patch for the past two years. Mum wants to divorce but dad doens't want fearing that he'll have to sell the flat and has no where else to go.

Are there any cases whereby once they divorce, one party is still able to keep the flat if the other agrees?

Hi all i would need advice out there

My husband and myself have been married for just slightly over 2 years. we have a HDB flat and we have stayed only for 2years too. Both of us are contemplating to go on our own separate ways.

Where do we go from here? I don't know whats the proceedings.I am Lost.

Watodo - Not that I am aware of. When Mum and Dad got a divorce two years back, the flat had to be sold.

Cina - Your question is too vague and too little background given. From my understanding, the flat cannot be sold within 5 years of purchase under this minimum occupation period rule.

this link may help: http://www.hdb.gov.sg/fi10/fi10203p.nsf/WPDis/Selling%20Your%20FlatMinimum%20Occupation%20Period?OpenDocument

I suggest you do up a list of questions you want answered, find a lawyer and seek professional advice. It's faster and clearer that way.

Hi Lyn,

Thanks for your reply. I'm really hoping that they can settle the house as this is the crux of the problem.

Has anyone encountered a situation whereby only one party's name is taken out of the house?

in simple terms, for one party to maintain the flat, you have to use cash to buy over the other party's share (even the CPF component)

I.e. if your spouse use 40K of his CPF for the flat, you gotto use cash to buy over that 40k he paid using his CPF.
