Annulment or divorce?

Hi Leong,

You may want to see your MP for advice during the "meeting people" session.

Do you still love her despite all this? If you do, try to interact with other men who married foreign brides.

Usually it is expected that the man has to support family in Singapore but also support overseas extended family too.

So don't whine about it.

But it is not as if you are in the losing end either. You do enjoy her as your wife, don't you?
So be glad to pay for her expenses. A lot of men pay without complaining.

Of course, she is wrong for not being truthful from the start. But you love her right, so will you forgive her?

magaz, yes, even after 4 yrs, if not consumated yet, can still annul. Under the law, there is no time limit set aside for annulment. The only criteria is that the marriage must not be consumated yet. The person asking for annulment is the proposer and he will file a statement with the lawyer. As long as the statement is not contested in court at time of hearing, the judge will grant annnulment.

As for the flat, HDB will not allow u to keep as the family unit has been broken. If still under 5 years, HDB will take back at 80% to 90% of ur purchase price. If after 5 yrs, u can sell in the open market

of cos, if there is a choice of annulment and divorce, it is alwasy better to annulment. Cos annulment means that under the eyes of law, the marriage never took place and ur status becomes single. When divorced, u become a divorcee. So whenever u fill in job application, u have to indicate divorced.

"When divorced, u become a divorcee. So whenever u fill in job application, u have to indicate divorced."

What is wrong with becoming a divorcee and being known as a divorcee?

When filling up forms, I will tick "Divorced" if there is such a selection, or "Single" if only given the choice of only "Single/Married".

I think filling up forms is not so important.. even if you have put single instead of divorced or vice versa - no big deal.

It is more for people who may have future partners (or their families) whom may not like "divorced" people as spouses. In such an instance, annulled status is preferable to divorced.

If filling up unimportant forms, doesn't matter what marital status you put as no one would be interested. But for insurance policies and job applications, etc, I would rather be on the safe side and put "Divorced" in case they find fault with my declaration later.

doll, there is nothing wrong being divorcee or indicating in forms as divorced.

It is as what sm has mentioned, some future partners mind but some don't

Oh, ok. But wouldn't you feel sad if your partner minds that you have divorced? Would you be able to continue in such a relationship?

Yes of cos. Everyone will feel sad. And I believe nobody wanted a marriage to end in a divorce or annulment but sometimes things just cannot be fixed. But our society is becoming more and more receptive. And if u find someone who loves u, he or she will not mind

Frankly, I won't be able to continue in a relationship with a guy who cannot accept that I had been married before. It's not a crime. It's not a disease.

Hello people. If anyone can PM a lawyer for annulment, it'll be much appreciated.

Also am I to understand that for annulment by non-consummation of marriage, both parties must admit and agree that this is the case? Thank you.

Hi vegastrong

How long u hv been married? if u want to annul by non-consummation of marriage, if too long, difficult for the court to believe

Hi. Come May would be first year. I really want out as I no longer feel like the woman I married is trustable and the woman I fell in love with. I guess that's what happens when someone has an affair and lies to you about it. Anyone know would such circumstances help my case?

Vegastrong,
HOH deals with annulment. U can give them a call. There's no complications since she had agree, the fees will be around 3k

It is not a love..we found out that everything so quick...now we decided to better off separated..his in the phils..and i dont have plan to go home there now..so for now we are bot longer husband and wife..we dont have a contact..in short we both agree that were sparated and has our own lives..now,i never registered our marriage to phil embassy..now what is the best thing to do with this situation??

Your best choice is to get an annulment in Singapore. If that's so, there is no need to declare in Philippines, and you'd be forever not married bf.

You have to understand the reason for annulment is basically to avoid the husband to come back the 'threaten' you for re-marriage, extorting money or sex or revenge.

Which is, if you are very sure he will NEVER be able to find you in Philippines, you don't have to bother about Singapore's ROM ALTHOUGH Women's Charters is international laws.

If you want to file in Philippines, it'd be advisable to acknowledge your marriage status after 3 years and declare that your husband has 'gone missing', thereafter you can effect a divorce on your side WITHOUT your husband's presence.

If your income is low, you may visit the local legal burea. If you are not a PR... please find a friend who'd take you to her/his MP.

You may also find your own lawyer. If he has no objection, any cheap lawyer will do. Because the issue is mainly to file and get a date.

If you want, you can obtain the forms for a fee from the court and file a date of hearing on your own and officially inform your husband to attend the court. The cost won't exceed $1,000, probably around $500.

See? 3 choices. Pick one.

If he will not go here for the hearing at 3 times..its automatically void?uhm,i just want to know what status am i here..because on my passport i never change it..still the same when i was single..we just had a rom..and thats it..havent file my papers...

As long as you ROM in any country recognizing Women's Charters, the marriage will be valid, and if you marry again and your husband reports or the authorities of any countries find out, you will be liable.

There is another way. Report in Philippines that your husband has gone missing for 3 years and apply for divorce. Then you don't need his presence. But he must be agreeable to this cos... he can file a complain that you falsify evidence to the court, and you will still be liable.

As for the how many times void thing... not in my knowledge.

Your current status is married.

The other way to do it... the more unusual way is to officially change your identity. The laws is a system, it goes by 'official identity', if you are granted a new identity (eg. if you are refugee from N Korea just to illustrate) even if North Korea is member state recognizing Women's Charters, but with state overrule, the marriage can be voided. This is however, a layer of law application most lawyers don't usually indulge in.

When it comes to international laws and application... 2 things. The laws may exist, but the legal representatives must have the ability to recognize and apply.

Need some advise here.

Me and my wife just got ROM and we both realised that we don't have that connection anymore. She was suggesting to annul the marriage next year before we hit the 1 year mark. Was wondering how's the procedure like and need some advise. As far as I don't want the annulment, but i don't want to see her so unhappy everyday.

On top of that, we have already gotten out flat and have moved in 1 year ago. What should we do? Will HDB take back the flat? I'm already 35 and wonder whether can i keep the place?

Need your previous advice on this.

Thanks!

I know 35 & above will be able to retain a resale flat by himself or herself with the other party's consent.

Her lawyer will send you documents to sign and file it to court. The plaintiff will have to attend court hearing and receive copies of your final judgement within 3mths after the hearing.

hi may i have information / fees / procedures for lawyer regarding annulment of marriage?
