Divorce and hdb matters

can someone help to clear my doubts?

My divorce is in progress. I’m asking to take over the hdb. I’m 35 years old. No kids. The flat is under MOP. I have asked my lawyer, the chances of me taking over the flat is 50 50. I also asked hdb, hdb only gave me a standard reply which is “the eligibility to retain the flat will be looked into upon finalisation of the divorce proceedings.”
And my divorce can only finalised after 3 months as informed by my lawyer.

I’m currently staying with my mother. He is staying in matrimonial flat.

As I have plan to sell away my mom flat and move in with her.

1. Should I start to look for buyers now before hdb confirm my eligibility?

2. If I start looking for buyer after, will hdb allow some time for me to sell the house before taking up a new loan? We have agreed on 12 months for the transfer to complete.

3. Should hdb disapprove the transfer, how do I appeal to hdb?

Eligibility criteria aside - assuming you can form a family unit with your mom (one of HDB's criteria amongst many including MOP, income etc) what is the mutually agreed selling price between your ex and yourself? I think that is a deal-breaker for most

And that's not including housing grants on the matrimonial flat and your mom's flat ....
 
1. Yes. You should start to look for buyers now. It can take years for flat to be sold, depending on the market and the buyer as well as property agent, if you have one.

2. Yes, HDB would give you time to sell. About 6 months

3. You would have to write to HDB or see your MP. For me, I wrote to the Minister for National Development in my HDB appeal before.

You managed to buy over your ex-wife's share? If sold on open market - was it sold during MOP or after?

I think TS is trying to buy over her spouse's share of the flat and HDB is non-committal in their reply.

Your writing to Minister of MND is solid :cool:

Wow, so directly write to minister for national development instead of hdb??

I plan to take over his share.. only if hdb don’t approve, then we will either appeal or sell.

I think there is no hurry to find a buyer if you intend to buy over his share after the decree nisi absolute.

Maybe you can check the valuation of the unit if you can although you'd be hard pressed to find the data since sales of similar unit in your area as I'd assume all the flats would still be under MOP (assuming you bought BTO) - I could be wrong though

Have your soon-to-be ex agreed to sell you his share and at what price? Suggest that if all these has been mutually agreed - put it in writing in the deed of separation or terms of divorce

hi there, if you have reached 35 years old, you can take over the flat even though you have no kids. at the minimum, you would have to refund his cpf and take over the existing loan by applying for a fresh loan. You can take bank loan now due to the lower interest rate.

Transaction was completed slightly after MOP but we started looking for buyers 1 year before the MOP. It was sold on open market. HDB is been tuned to only use standard templates in their replies. They have a list of standard replies in their computers. If you want action, it is best to go straight to the Minister.

The current procedure is such that you can only engage a valuer after signing of OTP. The procedure was changed many years back.

Hi , I hope someone could give me some advise here.
I have been divorced for 10 yrs . But I am still living in my Matrimonial home ...a 3 Room HDB flat.
it was supposed to be sold within 1 yr from the Court order date of my divorce . But since we didn't make any noise and I have no job and money
when I divorced we kept quiet and stayed on. for My ex, he does not live in SG (he lives in France) and he also has a selfish reason too, he is keeping it so the he will stay here when he is back in SG for his work or something so he could t save money on hotels . (he is not that nice as to let me stay without he having a benefit in it, he demanded the I have to keep a room vacant for him incase he comes back)

Now after 10 yrs and it is time move on , also partly because I have saved enough money to buy a new flat on my own.

What should I do ? what if my ex does not respond to my request to sell and act blur.
what if he does not turn up for the sale ? what should I do? it is a 3 room HDB flat...and in SG law it has to be disposed
within the said time. Now that it has lapsed for so many years ...how should I proceed?

I hope someone could give me some advise and steps to what I should do now...

Appreciate whatever help I can get here.
