Hi all, I and my ex-spouse had done our divorce and got our final in july 2010. But he has yet to complete the agreement of removing my name from the flat and refunding me my cpf contribution/acured interest. I had went through my HDB branch officer and she did managed to get in touch with my ex-spouse for the procedure to be done asap as my present spouse had applied for a bto flat and needs to sign the agreement soon for the loan. But still, my ex spouse did not proceed with wat he is supposed to do like submitting the HLE application for re-loan of the flat and to make arrangement for the transfer of my shares to him. I in need of advice or any good recommendations who can help me with this issue. Sincerely thank all if you could help.

In this situation, even if he starts the application for the housing re-loan, you will still require 3 to 4 months for HDB to complete the whole transaction even if he is applying for a re-loan. Thus you are bound to miss the BTO unless you appeal with HDB for a 3 to 6 months (subject to their approval) extension.

That said, HDB would require a prove that he has already proceeded with the re-loan and transfer to solely his name. There must be a paper trail to be submitted to HDB for the appeal. Hence that brings you back to square one.

Since Court would have issued an order back in July 2010 for the sale of the old matrimonial house, I would have taken steps to ensure that he done it back in 2010 and not more than 2 years later still procrastinating. Let's not then cry on spilled milk but look at the resolution.

I would only suggest that you bring this Court order and apply for immediate reinstatement of the Court Order and to enforce this to him should he delay further. That of course, is provided he don't agree or continue to drag on. It would be hassle thus you might want to engage your previous lawyer that assisted in your divorce previously to look into this for you. You have no other options unfortunately and again, your best bet is on the Court Order for the sale of the flat. Talk to him as well, sometimes being direct is cheaper than going a big round.

Hope it helps.
