Divorce: Sale of HDB Flat (Please HELP!!)

My sis is getting a headache from this issue. She & BIL divorce hearing is coming up in 2 weeks. The interim judgment will be given about end Aug and the final judgment around end Nov. Meanwhile, there's a buyer for their HDB flat which they bought from the open market and lived in for more than 5 years. But they heard that they need to engage their own lawyers because HDB could not act on behalf since the final judgment is not ready. Is this the case and what is the rationale? Sis divorce is uncontested so there is no complications. Please throw some light if you have any prior experience. TIA

I think once filed for divorce, cannot sell flat until judgment is passed - must obtain decree nisi absolute if I am not wrong.

Rationale is with regards to splitting of assets. After sale, who is going to get the proceed (if there is any after returning to CPF).

Please verify this with HDB / Lawyer / Other relevant authority.

Hi Samantha,

Your sister can call up HDB. Like what guy said, you can't sell your flat unless you get the decree nisi absolute - the final divorce paper, once you file for divorce.
