HDB matters in divorce cases

Hi, I am currently in the process of divorce.

1) After my divorce is finalized, how long will me and ex spouse be given to sell off the flat?

2) Me and the ex are currently unable to come to agreement to selling the flat before MOP. I am trying to convince her that the chances are quite high to sell in open market subject to HDB approval.Can we appeal to sell the flat in 2023 in open market if our actual MOP ends on 2024?


3) In the event of a failed appeal to sell before MOP, do we need to surrender the flat to HDB?? I have not heard of such surrender before.

Hi, I am in the same situation as you. Planning to divorce but MOP not meet yet. Anybody can share with us if you know somebody face the same issues?

Hi there, just to share my experience.

I have filed for divorce two years ago due to domestic violence issues and it was finalised mid last year. We had a hdb unit which has not met the MOP at that point of time when we got the final judgement (about 5-6 months prior to MOP). However, I did email hdb to seek approval for early sale. Hdb allowed us to sell the house in the open market before meeting the MOP.

I don’t think there’s a timeline as to when the unit has to be sold. My ex husband and I are still trying to sell the unit now. It has been about 8-9 months since the final judgement.

Perhaps you can try to write in to hdb with the supporting documents (eg, final judgement). Remember to state things clearly in your papers to prevent complications with your ex in future. Cos it’s really annoying and a pain to keep liaising with the ex when I really wanna start afresh.

I've a question to ask but I provide some background first:
  1. I have a P2 boy
  2. Owned a flat & fully financed by me; hers 0%
  3. In HDB eyes, she's not a co-owner. (P&C info and will not reveal)
  4. She's a full time home maker
  5. I've a full time job
If I were to go through a divorce (I believed it will be uncontested as she's the one that mooted the idea several times), is it better to:
  1. Let her & my son carry on staying in the flat where I still finance it fully and pay her alimony or
  2. Get her to be co-owner and we sell off the house eventually and I will still pay alimony?
While being separated, I intend to rent a super cheap, small room for myself and eventually staying long term. I'm a no fuss person. Basic necessities are enough, no money for luxury.
