hey there .. I need some help on divorce , hope can get my questions answered here.

1) I got some of his clubbing and nightclub photos.. with girls sitting on top of him.. Is the photos good for adultery ?

2) Our flat is resale open market with CPF grant. If we file for divorce, can we keep the flat or do we have to sell the flat immediately?

3) We are married for 2 yrs. I understand it takes 3 yrs to divorce , is this true ?
 
1. Yes. Best to consult lawyer to ascertain the evidence you have on hand.

2. Upon Nisi Decree (final judgement), Court will stipulate period to the sale of the flat (normally agreed by both party of 3-6 months or even more). However, Court cannot overrule the HDB requirements of fulfilling 5 years MOP (Minimum Occupancy Period) since a grant is taken hence you need to fulfill this. However that being said, either party can still appeal to keep the flat under the following circumstances:

- There must be a final judgement to the divorce issued from Court.
- Either party can take over the flat provided:

a) Either party taking over must be 35 years old and above
b) Either party taking over must create a family nucleus eg: joint name with brother, sister, parents etc on the basis they do not own any HDB or property for that matter. (HDB Requirements still applies)

If MOP is not fulfilled or above requirements can't be met, this will result in surrender of flat to HDB at 80% reimbursement based on your valuation at the time of purchase and NOT current valuation.

3) Under Woman's Charter, following are the required reasons for filing divorce:

- Annulment (Must prove no consumation etc)
- Unreasonable Behaviour
- Adultery
- Separation (3 years for agreed separation and 4 years for either party disagreement or no show).

Best to engage with lawyer or HDB (your nearest Town Council) to enquire further.
