Divorce + HDB Flat Enquiry

Hello all,

First of all, thank you so much for stopping by my thread. Im just so confused by the procedures i really need your advice.

Basically, my ex-wife (legally wife) and i have decided to separate because she committed fidelity. (Separate as in, we are currently staying at different places, she is occupying the flat and i have moved out) However we are currently in a possession of a HDB flat and this is our 2nd year of occupying the flat. We intend to sell the flat away after the MOP. My question is, do we file for a 3 years separation now, divorce after the MOP date and then sell the flat away or do we have to wait for the MOP date to pass before filing for separation?

Please kindly advice, thank you.

Hi livingincm, very sorry to learn ab0ut your situation. If i am not wrong, you can file for separation first while waiting for the MOP. Not sure how long your marriage is but in some cases, to speed up the case or rather to lessen the pain, the couples would agree to file for annulment instead.

i think if i am not wrong, you dont need to wait for 3 years to file for divorce. it is up to your lawyer on how he/she submits the case to court. my friend got a divorce after only 2 years of marriage (wife also met a new guy). but i am not sure how the lawyer did it (definitely not an annulment) the only drawback was, they had to sell the flat back to HDB and it was definitely not the best price. better to seek lawyer's advice. or maybe you can try calling HDB up to find out.

Sorry for hijacking the thread. Not sure if anyone can advise. Husband wants to divorce and has written an appeal on his own to sell the flat (2nd hand flat), couple only married for 2 yrs i.e. stayed in the flat 2 yrs only. Is this possible? From what I know wife is not agreeing to the divorce.

Both applicant have to agree to sign the cancellation OR submit appeal to HDB to surrender the flat to HDB. HDB will then sell the unit at market price. IF the wife is not agreeable to sign, basically you cant do much about it. What I can advise is that, have a talk with her and get her to agree.

icic, so means the husband has to file for seperation then wait for divorce before they can sell the flat?

the wife wont agree. cos the husband is the one committing fidelity. thank you xellos anyway! appreciate it.

I am with my husband for 13 yrs and registered our marriage last year. We have yet to gone through our customary and had filed for a BTO flat but have not collected it. I found our that he had an affair and the woman is pregnant. I told him that I am willing to forgive him if he let the woman go but he is unable to because of his child. As such, I have to do all the necessary as he ignoring everything now.

I would like to file for a divorce (though married less than 1 year) or an annulment of our marriage at the lowest possible cost. Do all of you know the process and if you have any lawyer to recommend ? Thanks

U can PM me for a lawyer.
I filed my divorce in 2011 and lawyer charged me $2800 and that jerk refused to pay...
