Advice Needed - Surviving Spouse""

A friend's husband had passed away recently. The car is under her hubby's name and still have outstanding loan. She intend to sell the car since she cannot drive. Is she able to do so since the name is not hers? What must she do?Must she engage a lawyer to do the name transfer?

Pls advice.

Hi. She needs to get a lawyer to settle these issues and get a letter of probate. The letter of probate will allow your friend to sell the car.

However, as the completion of the probate will take some time (anything from 3 months to a year - my late father's probate took my family a year to complete), your friend might have to service the outstanding loans of the car.

Ask your friend to engage a lawyer regarding the probate and the car loan. She may approach the lending bank about the loan too.

Depends on the law firm. I won't recommend the lawyer that we engaged as he dragged the procedures when he could shorten the time frame, hence the one year and three months wait (we complained to the head office after that). However, I would still let you know the name of law firm. It's Hoh and Partners. Can't remember the name of the lawyer who handled the case. I think we forked out about $2000. That was in 2001-2002, I think.
